2015-09-22 Liquor License Transfer Hearing


Council met in special session regarding the transfer of a liquor license on Tuesday, September 22, 2015. Mundie called the meeting to order at 5:30 pm.

Council President Jack Mundie, Council Vice President Jean Mope, and Council Members Jeff Cusat and Dave Sosar were present. Also present was Attorney Joseph Mashinski.

This hearing was conducted to discuss the transfer of liquor license No. R-6543 and LID No. 12288 from Clementine N. Macario t/d/b/a Lincoln Inn, 117 Lincoln Street, Dupont Borough, Pennsylvania to SAI Hazleton, LLC for premises located at 285 South Church Street in Hazleton.

Attorney Joseph Mashinski was present to represent SAI Hazleton, LLC. The liquor license is being transferred from Dupont Borough to Hazleton. It will be used for premises located at 285 South Church Street, Hazleton, which is currently operating as a Unimart, and will be owned by the same individuals. It will not be changing owners. Sosar was concerned with transferring liquor licenses across county lines. Attorney Mashinski said they would prefer to purchase a license from Hazleton, but none at existed at the time. Sosar asked if Lackawanna County needs to approve this. Attorney Bob Cohen, City Solicitor, said there is no difference in the standard for approving a liquor license transfer. Attorney Mashinski said they will only be serving and selling beer. The store will be remodeled and the occupancy will be less than 50 people. Only two six packs can be sold to one individual at a time. There will be a separate entrance. There will be no music or entertainment. Mope asked if this is a bar license or restaurant license. Cusat said this would fall under a bar/restaurant. Mashinski stated they will be open Monday to Saturday, 9:00am-10:00pm, and Sunday from 11:00am-10:00pm.

Mundie made a motion to adjourn the meeting at 5:45 pm, and Mope seconded the motion. Meeting adjourned.
