ORDINANCE 2015-16

An Ordinance Regulating Parking within the City of Hazleton and
Establishing a Schedule of Fines for Violations Defined in the
Various Classifications of Said Regulations

WHEREAS, it is necessary for the general health, welfare, and safety of the public and the citizens of the City of Hazleton that parking be regulated within the City; and

WHEREAS, it is the desire of the Council of the City of Hazleton to establish parking regulations and a schedule of fines for violation of those regulations; and

WHEREAS, the City Code vests in City Council the authority to impose fines and penalties.

NOW, THEREFORE, BE IT HEREBY ORDAINED AND ENACTED that the Council of the City of Hazleton establishes the following parking regulations and schedule of fees for violations (all fines are to be imposed on a per violation/per day basis):

Section 1. Parking Regulations

No motor vehicle of any kind shall be permitted to park at any time in the City of Hazleton as follows:

A. Within fifteen (15') feet of a fire hydrant or in a designated fire zone as noted by a line, sign, or red paint on the curb or street.

B. Parked or stopped in a lane used by moving traffic.

C. In a manner that obstructs or blocks vehicular or pedestrian traffic.

D. Within twenty (20') feet of the driveway entrance to any fire station or, when a sign is properly posted, on the side of a street opposite the entrance to any fire station within seventy-five (75') feet of the entrance.

E. On any railroad tracks.

F. In a space designated by the City of Hazleton or its designee as a handicapped parking zone, unless the vehicle parked in that zone is the vehicle authorized to be parked in that handicapped parking zone, by permit, for handicap parking.

G. It shall be illegal to park a vehicle with a missing or expired inspection or registration sticker.

H. In a designated snow maintenance area.

I. Within thirty (30') feet upon the approach to any flashing signal, stop sign, yield sign, or traffic-control signal located at the site of a roadway.

J. In an area designated as prohibited parking by temporary regulations, when signs are erected giving notice.

K. In a manner that constitutes double parking.

L. In a manner that obstructs a crosswalk or sidewalk.

M. In parking in a zone designated for the use of motor buses or other means of public transportation.

N. Within fifty (50') feet of the nearest rail of a railroad crossing.

O. In a manner that blocks an entrance to or exit from a public or private driveway or garage.

P. In a posted “No Parking Zone” by signs and lines.

Q. At any place where official signs prohibit parking.

R. In a designated street sweeping area.

S. Within twenty (20') feet of any intersection.

T. Facing the wrong direction.

U. Opposite the flow of traffic.

V. More than twelve (12สบ) inches from the curb.

W. At an improper angle.

X. On a sidewalk or curb.

Y. In a designated loading zone area.

Z. In parking at a metered space longer than the designated time limit.

AA. In parking outside of the delineated space provided for parking meters.

Any person violating Sections 1A, 1B, 1C, 1D, and/or 1E of this Ordinance shall pay a fine of One Hundred ($100.00) Dollars if paid within five (5) calendar days, and One Hundred Twenty ($120.00) Dollars after such five calendar-day period, as well as the costs of prosecution and penalties. The vehicle involved will also be subject to removal by towing and may be subject to processing and storage fees at the owners expense.

Any person violating Sections 1F, 1G, 1H, 1I and/ or 1J of this Ordinance shall pay a fine of Seventy-Five ($75.00) Dollars if paid within five (5) calendar days, and One Hundred ($100.00) Dollars after such five calendar-day period, as well as the costs of prosecution and penalties. The Vehicle involved will also be subject to removal by towing and may be subject to processing and storage fees at the owners expense.

Any person violating Sections 1K, 1L, 1M, 1N, 1O, 1P, and 1Q of this Ordinance shall pay a fine of Forty ($40.00) Dollars if paid within five (5) calendar days, and Fifty ($50.00) Dollars after such five calendar-day period, as well as the costs of prosecution and penalties. The Vehicle involved will also be subject to removal by towing and may be subject to processing and storage fees at the owners expense.

Any person violating Sections 1R, 1S, 1T, 1U, 1V, 1W, 1X and/or 1Y of this Ordinance shall pay a fine of Thirty ($30.00) Dollars if paid within five (5) calendar days, and Forty ($40.00) Dollars after such five calendar-day period, as well as the costs of prosecution and penalties.

Any person violating Sections 1Z and/or 1AA of this Ordinance shall pay a fine of Ten ($10.00) Dollars if paid within five (5) calendar days, and Twenty ($20.00) Dollars after such five calendar-day period, as well as the costs of prosecution and penalties.

Any ordinance or part of an ordinance conflicting with the provisions of this Ordinance shall be and the same is hereby repealed to the extent of such conflict.
