ORDINANCE 2017-14

Amending Chapter 118 (Drugs and Drug Paraphernalia) of the Hazleton City Code, Regarding Violations and Penalties for the Sale, Conveyance, or Possession of Drug Paraphernalia

WHEREAS, the City of Hazleton adopted Chapter 118 of the City Code, which defines, determines use, and sets penalties for attempts to sell, convey, or possess drug paraphernalia; and

WHEREAS, it has come to the attention of City officials that the violations and penalties provision contained in Section 118-3 must be clarified for law enforcement and judicial entities of the City of Hazleton.

NOW, THEREFORE, BE IT HEREBY ORDAINED AND ENACTED by the Council of the City of Hazleton, as follows:

  1. Chapter 118 of the City Code at Section 118-3, Violations and Penalties, is amended as follows:
  • 118-3. Violations and Penalties.           

Anybody attempting to sell, convey or possess drug paraphernalia as defined in this chapter shall be guilty of a summary offense punishable by a fine not         exceeding $300.00 or a prison term which shall be fixed by the Court at not more than 90 days, or both.    

BE IT FURTHER ORDAINED that all relevant ordinances, regulations and policies of the City of Hazleton not amended hereby will remain in full force and effect; and

BE IT FURTHER ORDAINED that if any provision, paragraph, word, section, subsection, sentence or clause of this Ordinance is held to be invalid by any court of competent jurisdiction, such decision will not affect the validity of the remaining portions of this Ordinance; and

BE IT FURTHER ORDAINED that any ordinance or part of an ordinance conflicting with the provisions of this Ordinance, including the ordinances cited herein, is repealed to the extent of such conflict.
